Declared production organisation - Part 21L.G
Before an organisation that intends to demonstrate the conformity of products or parts with the applicable design data starts to produce the products or parts in question, it shall make a declaration of its production capability in a way that the natural or legal person declare its production capability on form Declaration of production capability (AIR.OBR-209).
The same is required in case of a significant change of the organisation.
Organisation that declares its production capability to produce small aircraft , including their engines, propellers and parts, certified in accordance with Subpart B (small aircraft), D (change to aircraft of Subpart B), E (supplemental type certificate to aircraft of Subpart B) and M (repair to aircraft of Subpart B) or parts for which the declarant has declared compliance of the design with Subpart C (very small aircraft), F (change to aircraft of Subpart C) and N (repair to aircraft of Subpart C) and for which, if the holder of design or declarant of design compliance himself/herself is not the natural or legal person, the holder of design or declarant of design compliance has granted access to the applicable design data, if declare its production capability in accordance with this Subpart is allowed to begin production without prior approval by the competent authority.
Aircraft and other products from Subpart B, of Annex Ib (Part 21 Light), of Regulation (EU) No. 748/2012 are:
1. an aeroplane with a maximum take-off mass (MTOM) of 2 000 kg or less with a seating configuration of maximum four persons,
2. a sailplane or powered sailplane with an MTOM of 2 000 kg or less,
3. a balloon,
4. a hot air airship,
5. a passenger gas airship designed for not more than four persons,
6. a rotorcraft with an MTOM of 1 200 kg or less with a seating configuration of maximum four persons,
7. a piston engine and fixed pitch propeller that are intended to be installed on an aircraft referred to in points (a) to (f). In such cases, the type certificate data sheet shall be appropriately annotated to only permit installation of the engine or propeller on such aircraft and
8. gyroplanes.
Aircraft from Subpart C, of Annex Ib (Part 21 Light), of Regulation (EU) No. 748/2012 are:
1. an aeroplane with a maximum take-off mass (MTOM) of 1 200 kg or less that is not jet-powered, and has a seating configuration of maximum two persons,
2. a sailplane or powered sailplane with an MTOM of 1 200 kg or less,
3. a balloon designed for not more than four persons and
4. a hot air airship designed for not more than four persons.
By declaring its production capability, the organization ensures that it has established, implements and maintains an appropriate production management system and is capable of fulfilling the obligations of the declared production organization, as are defined in more detail in point 21L.A.127 of Subpart G of Annex Ib (Part 21 Light) to Regulation (EU) No 748/2012. It is highly recommended that the necessary procedures of the organisation are described in the Declared Production Organisation Exposition (DPOE). The content of the relevant DPOE is presented in the appendix to the form Declaration of production capability (AIR.OBR-209).
After receiving the declaration of production capability, the competent authority will issue an appropriate confirmation of receipt of the declaration and, as part of further procedures, will regularly or periodically verify the adequacy of the production management system and the ability to undertake the obligations and, as part of this verification, provide appropriate information on adequacy or compliance.
