Just culture complaint body according to Article 16(12) of the Regulation (EU) No 376/2014

Article 16(12) of the Regulation (EU) No 376/2014 requires the Member States to designate a body responsible for the implementation of Article 16(6), (9) and (11).

In the Republic of Slovenia this body is established in the CAA, by the decision of CAA Director. It is called Just Culture Complaint Body and it is established specifically for fulfilling the responsibility defined by the regulation.

The Just Culture Complaint Body consists of three members, CAA employees, two of them are permanent members of the body and one is appointed on case-by-case basis, depending on subject matter of the complaint.

The Just Culture Complaint Body is completely independent from CAA Management, meaning that members of the Safety and/or Management Board cannot be members of the Just Culture Complaint Body and they cannot interfere with the decisions of the Body.

Employees and contracted personnel of the organisations established in the Republic of Slovenia may report to Just Culture Complaint Body alleged infringements of the rules established by Article 16. Employees and contracted personnel shall not be penalised for reporting alleged infringements and the Just Culture Complaint Body shall guarantee a high level of confidentiality.

The Just Culture Complaint Body is responsible for:

-     receiving and handling employees and contracted personnel alleged infringements of the rules;

-     advise the CAA on the adoption of actions against those who infringe the principles of protection of the reporter and of other persons mentioned in occurrence reports, such as remedies or penalties;

-     upon its decision, reviewing 'Just Culture' internal rules of organisations established in Slovenia.

Employees and contracted personnel of the organisations established in the Republic of Slovenia may report the infringements to Just Culture Complaint Body by e-mail: jccb@caa.si. In addition, they may also inform Commission about such alleged infringements.
